The petitioner, who is a foreign national, is facing trial in connection with FIR No. 68/2018 filed before the Anjuna Police Station under Section 370(A)(2) read with Section 34 of the IPC and Sections 4 and 5 of the Immoral Traffic (Prevention) Act, 1956. The petitioner's bail Application came to be allowed by an order dated 25.06.2018 passed by the learned Sessions Judge. 2.
In the present proceedings, the petitioner is concerned with condition no. (c) of the said order, which is to the effect that the petitioner shall surrender his passport to the investigating officer, within two days of his release and in case, if he does not have his passport, then to file an affidavit to that effect in the Court with a 5 September 2022
9 WPCR 62 OF 2022.ODT copy of the affidavit to the investigating officer. The other condition is that the petitioner will not leave the State of Goa without permission of the Court.

The petitioner approached the learned Sessions Judge by filing Criminal Miscellaneous Application No. 12/2022, praying that the above-noted conditions in the bail order be modified and the petitioner be permitted to travel to Russia. Such an Application was rejected by the learned Sessions Judge by an order dated 15.03.2022, primarily on the ground that, pending trial if the petitioner is allowed to travel to Russia, it would be difficult to secure his presence. It is in these circumstances that the petitioner has approached this Court in the present proceedings. 4.
I have heard the learned Counsel for the applicant and the learned Public Prosecutor for some time.

After the proceedings were heard for some time, the learned Counsel for the applicant seeks leave to withdraw this Petition with liberty to take recourse to appropriate proceedings, at the appropriate time. Allowed to be withdrawn with liberty as prayed for.
