Feroz Mohamad Hussein Katwalia And 3 ORS., v. Firoz Khan And 18 ORS.,
IN THE HIGH COURT OF BOMBAY AT GOA
WRIT PETITION NO. 300 OF 2019 FEROZ MOHAMAD HUSSEIN KATWALIA AND 3 ORS., ... Petitioners
Versus
FIROZ KHAN AND 18 ORS., ... Respondents Ms. Annelise Fernandes, Advocate for the Petitioners. Coram:- C. V. BHADANG, J.
Date:- 13th March 2019 P.C.
Heard the learned Counsel for the petitioners.
2. The only limited relief sought in this petition is for expedited hearing of the application, exhibit D-26, which is pending before the learned District Judge at Mapusa in Civil Suit No.3/2017.
3. A perusal of the record shows that an exparte relief was granted to the respondents on 21.07.2017 and the learned Counsel for the petitioners submits that till today that order has neither been confirmed nor vacated. Such a situation cannot be countenanced as ad-interim orders are normally supposed to be of short duration as they are drastic in nature as they are passed behind the back of the party against whom, such orders operate.
WP/300/2019 It is therefore necessary for the Court to decide the question of confirmation of the order after hearing the other side as expeditiously as possible.
4. In that view of the matter, the petition is disposed off with a direction to the learned District Judge to decide the application, exhibit D-26, as expeditiously as possible and, in any event, within a period of one month from the receipt hereof.
5. The petition is disposed off.
C. V. BHADANG, J.
