The appellant was convicted for the offences punishable under Section 376 and Section 506(ii) of the I.P.C. and by the impugned judgment dated 11.09.2012, was sentenced for seven years and to pay fine of Rs.25,000/- to the victim girl and in default to suffer further R.I. for one year for the offence punishable under Section 376 of the IPC. For the offence punishable under Section 506(ii) of I.P.C., the appellant was sentenced to pay a fine of Rs.5,000/- and in default to undergo R.I. for two months.

2. The appellant since after his conviction and sentence has undergone the entire sentence as awarded and has been set at

CRIA/22/2014 liberty.

3. Shri Gaonkar, learned Advocate, on instructions from the appellant who is personally present before the Court submits that the appellant is not desirous of prosecuting the appeal.

4. In such circumstances, the Criminal Appeal is dismissed for want of prosecution.
