By this application from the State, basically seeks modification of the direction contained in paragraph 69 of our Judgment and Order dated 17.08.2020.

The learned Advocate General pointed out that on account of the pandemic situation and resulting financial crunch, the State is adopting several austerity measures. One of the measures is the direction given to all Departments that no expenditure sanctions will be granted/issued for issue of work orders until the end of December 2020 unless a special case of grave urgency is made out by the concerned Department. Learned Advocate General pointed out that this is the policy which is consistently being followed in respect of most of the works and, therefore, the direction for issuance of work order to the original petitioner within a period of four weeks be modified.

The learned Advocate General states that the work order will be issued to the petitioner in January, 2021.

According to us, the request made by the applicant is quite reasonable in the circumstances and, therefore by accepting the statement of the learned Advocate General, we extend the period referred to in paragraph 69 of our judgment and order up to 2 nd week of January, 2021.

This application for modification is disposed off in the aforesaid terms.
