Heard Shri Vales, the learned Counsel for the appellant and Shri Ramani, the learned Counsel for the respondent no. 4.

2. On hearing the learned Counsel for the parties at length, when this Court was not inclined to entertain the appeal, Shri Vales, the learned Counsel for the appellant, on instructions, submits that the appellant intends to approach the D.R.T., by filing an appeal under Section 17 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. In that view of the matter, he seeks permission to withdraw the appeal.

3. Shri Ramani, the learned Counsel for the contesting respondent (respondent no. 4) has no objection for withdrawal of the appeal.

4. In such circumstances, the appeal is dismissed as withdrawn, with no order as to costs.
