The learned Counsel for the parties submit that the election to the State Legislative Assembly are over and the result of the election was declared on 11/03/2017 and the new Legislative Assembly is formed on 14/03/2017. It can thus be seen that the respondent no.1 no longer continues to be the member of the Legislative Assembly. In such circumstances, the learned Counsel for the parties submit that this Court may pass appropriate order.

2. Considering the fact that the respondent no.1 no longer continues to be the member of the Legislative Assembly nothing survives in the Election Petition, which is accordingly disposed off as infructuous. In the circumstances, there shall be no order as to costs.
