Heard Mr. Arvind Kumar Shukla, Mr. Prayash Shirodkar and Mr. Nihal Ahamad, the learned Counsel for the petitioners and Mr. Pravin Faldessai, the learned Additional Public Prosecutor for the Respondents.

After this matter was argued for some time, Mr. Shukla, on instructions, seeks leave to withdraw this petition with liberty to place documents and explanation before the Investigating Officer. He submits that some directions be issued to the Investigating 26th July 2021

4-WPCR-32-2021.DOC Officer to consider such documents and the explanation that the petitioners will offer in the matter.

Mr. Faldessai, the learned Additional Public Prosecutor states that if any documents are produced and explanation is offered by the petitioners, then the Investigating Officer, in the course of his investigations, will certainly consider the same. 4.

Accordingly, we grant leave to the petitioners to withdraw this petition with liberty to place documents/explanation before the Investigating Officer. The statement of Mr. Faldessai that such documents/explanation will be considered by the Investigating Officer in accordance with law and on its own merits is also accepted.
