Shri V. Kurtikar, learned Advocate for the respondents submits that he has no objection to the release of 50% of the amount subject however to an undertaking to be furnished by the applicant to indemnify the respondents.

2. Accepting the statement of Shri Kurtikar, learned Advocate for the respondents, the application is allowed. The applicant is allowed to withdraw 50% of the amount deposited subject however to the applicant furnishing an undertaking in the Registry to indemnify the respondents in the event, he fails in the appeal.
