We have heard Mr. Talaulikar for the petitioners, Mr. D. Pangam, learned Advocate General along with Mr. Deep Shirodkar, learned Additional Government Advocate for the State and Mr. A. D. Bhobe for respondent no.2.

2. After perusing the averments in the Civil Application, we do not find that any ground has been made out to direct the petitioners to implead the applicants as either the respondents or the intervenors in this matter. There is no allegation in the application that the original petitioners are not pursuing the petition properly or that they are likely to abandon the petition.

3. Accordingly, this application seeking impleadment as respondents or as intervenors is rejected. This shall be without prejudice to the petitioners taking up independent proceedings if they so chose to. Such independent proceedings, if taken up, will be considered on their own merits and records.

4. The Miscellaneous Civil Application is disposed of in the aforesaid terms.
