Perused the records particularly the Judgment rendered by the learned Judicial Magistrate convicting the applicant under Section 138 of the Negotiable Instruments Act and the Judgment in Appeal rendered by the learned Sessions Judge, Mapusa upholding the conviction of the applicant. It is apparent that the applicant has a good case to succeed on merits. Pending the hearing and disposal of the revision, sentenced imposed is stayed subject however to the applicant depositing an amount of Rs.35,000/- within a week from today and in view of the clear submission on instructions that an amount has been deposited before the Additional Sessions Judge, Mapusa.
