The petition seeks a writ of mandamus against respondents No.1 to 5 for immediate stoppage of construction work undertaken by respondents No.6 to 8. It appears that the Village Panchayat of Cortalim has already issued a stop work notice to respondents No.6 to 8. The respondent-Panchayat is seized of further proceedings. Learned Counsel for the private respondents (respondents No.6 and 7) informs to the Court that his clients have stopped the work at site in response to the notice. The Panchayat shall complete its enquiry and pass an appropriate

2 WP 322/19 order. All rights and contentions of the parties on the merits of the case are kept open. The petition stands disposed of. 2.

It is made clear that whilst considering the legality of the construction, which is the subject matter of the present petition, the respondent- Panchayat shall also hear the petitioner. PRITHVIRAJ K. CHAVAN, J.
