Learned counsel for the appellant submits that the appellant does not wish to press the Second Appeal as it is his contention that once the order has been passed by the trial Court holding the issue of limitation against the appellant, it is for the appellant to take appropriate steps challenging the order of the trial Court.

2. Learned counsel Ms Gawde opposed this request. However, it is at the request of the learned counsel for the appellant, on instructions, the appeal is allowed to be withdrawn with liberty to challenge the order dated 30.07.2024 of the trial Court before the 25th October, 2024

SA 38 of 2023 appropriate Court. I have not heard the parties on the merits of the contentions in this appeal. The Second Appeal is disposed of accordingly.
