Heard Mr. S. Mahambrey, learned counsel appearing for the applicants and Mr. V. Pangam, learned counsel appearing for the respondent.
2. The application was filed on the premise that as the applicants had terminated the appointment of the learned Arbitrator by this Court, a fresh Arbitrator had to be appointed. But however, during the course of the hearing of the above application, Mr. Mahambrey, learned counsel appearing for the applicants upon instructions states that the applicants withdraws the letter addressed to the learned Arbitrator dated 01.02.2016 purporting to terminate the mandate to proceed with the arbitration. In view of the withdrawal of the said letter dated 01.02.2016, the relief sought in the above application would no longer survive.

3. Hence, Shri V. P. Shetye, the Arbitrator appointed by this Court shall proceed to adjudicate the dispute in terms of the earlier order dated 06.12.2013.
4. Mr. Mahambrey, learned counsel appearing for the applicants points out that the Arbitration Proceedings may be expedited. Mr. Pangam, learned counsel appearing for the respondent submits to the order of the Court.
5. In the facts and circumstances of the case, the Arbitrator was appointed in the year 2013 and as such is requested to expeditiously adjudicate the dispute in accordance with law.
