This petition challenges an order dated 1/04/2015 passed by the District Judge - 1, Mapusa. By the impugned order an ex-parte ad interim relief was granted on the application of the respondent no.1. This without having heard the petitioner, even though a caveat had been filed by the petitioner and the respondent no.1 was informed about the same.
2. After the matter was heard for some time, Mr. R. Menezes, learned Counsel appearing for respondent no.1, on instructions, states that by consent the impugned order dated 1/04/2015 may be set aside. However, he points out that serious prejudice is likely to be caused to him if his application for condonation of delay and for ad interim
WP/281/2015 relief is not heard at the earliest. I am informed by the Counsel that the District Judge, Mapusa has kept the matter on 21/04/2015. It is expected that the learned District Judge would dispose of the application for condonation of delay, ad interim relief and/or interim relief after hearing the parties expeditiously.
3. In view of the joint request of the parties the impugned order dated 1/04/2015 is set aside. The writ petition is disposed of in terms of the above directions.
