Heard Shri C. Padgaonkar, the learned counsel for the petitioner and Shri D. Lawande, the learned Advocate General appearing for the Respondents.
2. This is a petition challenging an appointment joining order issued by the State Government pursuant to the directions issued by this Court by the judgment dated 25/11/2016. It is contended by Shri Padgaonkar, the learned counsel appearing for the petitioner that the original appointment of the petitioner was at Cuncolim, whereas as per the impugned order/direction the petitioner has been asked to report at Mollem which is at a distance of 60 kms. from the earlier posting. The learned counsel further points out that there is no justification in such direction as
WP/341/2017 according to him the respondents have acted malafidely in complying with the directions of this Court. The learned counsel as such submits that the impugned direction be quashed and set aside. We are not inclined to interfere in exercise of our extraordinary jurisdiction to quash the impugned direction passed by the respondents. It is not disputed that the petitioner has already been absorbed in the services of the State Government pursuant to the directions of this Court. There are no specific malafides raised against any particular person who is a party in the petition. Hence the petition is rejected. NUTAN D. SARDESSAI, J.
