Heard Mr. R. Chodankar, learned counsel appearing for the applicant and Mr. S. R. Rivonkar, learned Public Prosecutor appearing for respondent no.2.

2. This is an application for suspension of sentence of imprisonment awarded by the learned J.M.F.C., Mapusa in Other Act No. 161/NIACT/2009/F dated 03.10.2013 and the learned Sessions Court, North Goa, Panaji, in Criminal Appeal No.115/2013 dated 06.02.2015.

3. In the facts and circumstances of the case and taking note of the fact that the applicant was released on bail during the pendency of trial and appeal, I find it appropriate and in the interest of justice to pass the following :

CRMA/108/2015 O R D E R (i) The operation and execution of the sentence imposed by the impugned judgments dated 03.10.2013 and 06.02.2015 are suspended and the applicant is directed to be released on bail subject to furnishing a personal bond of Rs.15,000/- with one surety in the like amount to the satisfaction of the Registrar (Judicial ) of this Court, on the condition that the applicant should deposit the half of the compensation payable to the complainant.

(ii) The applicant shall remain present before this Court at the time of the final hearing of the above petition. (iii) The applicant shall not leave the country without seeking permission of this Court.

(iv) The application stands disposed of accordingly.
