For the reasons separately recorded the petition is allowed. The impugned order is hereby set aside subject to the petitioner paying cost of Rs.20,000/- (Rupees twenty thousand only) to the respondent within two weeks from today.

2. The petitioner shall keep DW.1 positively present on the next date of hearing before the learned trial court for further cross examination. The payment/deposit of the costs is a condition precedent for setting aside of the impugned order.

3. The suit is of the year 2007 and hence the trial court shall decide the suit as expeditiously as possible and preferably within a period of six months from the receipt hereto. The petition is

WP/448/2018 disposed of in the aforesaid terms.
