A perusal of the order dated 28th February, 2019, passed by the Inspector General of Prisons, Panaji Goa, indicates that the application for furlough filed by the Petitioner is rejected on the ground that there is an adverse report against the Petitioner and the brother of the Petitioner refused to accept the Petitioner and to furnish any surety on his behalf. Though the Petitioner had agreed that his son would furnish the security, the Authority has rejected the application for furlough on the ground that brother has refused to accept him during the furlough period and refused to furnish surety to release the Petitioner. The impugned order dated 28th February, 2019 is accordingly quashed and set aside.

2. The Respondent No.1 is directed to consider the application of the Petitioner for furlough on the premise that the son would furnish the surety and would accept him during the furlough period. The application shall be considered by the Respondent No.1 expeditiously.

3. The petition is disposed of on the aforesaid terms. There shall be no order as to costs.
