After hearing the matter for some time, the learned Counsel for the appellant seeks leave to withdraw the Second Appeal. The Second Appeal is dismissed as withdrawn.

All contentions are specifically left open. Both the suit and the counter-claim will be tried on their merits, without being influenced either by the order dated 20th January 2017 or the present order.
