Heard Shri M. Amonkar, learned Advocate appearing for the petitioner, Shri A. Prabhudessai, learned Addl. Govt. Advocate appearing for the respondent nos.1 to 3 and Shri N. Vaze, learned Advocate appearing for the respondent no.4.
2. The main grievance of the petitioner is that though all the formalities as required under the law have been complied with for the purpose of registering the sale deed before the Sub-Registrar at Pernem, the concerned Sub-Registrar has not yet registered such sale deed.
3. The learned Counsel appearing for the respondent no.2 upon instructions states that in case the petitioner files an undertaking before the concerned Registrar to the effect that the subject property shall not be used for any other purpose then the one mentioned in the
WP/402/2016 sale deed, the respondent no.2 shall proceed to register the sale deed in accordance with law.
4. Mr. Amonkar, learned Counsel states that such undertaking shall be produced before the concerned Registrar within two days from today.
5. In view of the above, the petition stands disposed off and the respondent no.2 shall accordingly proceed to register the sale deed in accordance with law.
