Te learned counsel for the parties hand in terms of compromise which are taken on record and marked as 'X' for identification.

Te terms of compromise are signed by the appellant and the respondent who are present in the Court. Tey say that they have signed these terms after understanding their full scope and import. Te terms of compromise are also signed by the 28th July 2023

I have perused the terms of compromise and they are not opposed to public policy. Terefore, there is no good reason not to accept the terms of compromise and dispose of this Second Appeal based on them.

Accordingly, this Second Appeal is disposed of based on the terms of compromise today handed in. Te undertakings in the terms of compromise are accepted as undertakings to this Court. Te respective parties will have to comply with the same. 6.

Paragraph 11 sets out the precise terms which the parties have agreed to abide by.

Accordingly, there shall be a decree in terms of the compromise terms.

8.

Te Second Appeal is disposed of in the above terms without any cost order.
