Heard the learned Counsel for the Applicant and the learned Public Prosecutor for the Respondent-State.
2. The Applicant has been convicted for the offence punishable under Section 2(y)(ii) read with Section 8(2) of the Goa Children's Act, 2003 and is sentenced to under go simple imprisonment for a period of one year and to pay a fine of Rs.1,00,000/- and in default to undergo simple imprisonment for one year.
3. The Applicant was on bail during the course of the trial.
4. The learned Counsel for the Applicant, on instructions, states that the Applicant-Appellant shall deposit the amount of fine within a
CRMA/65/2016 period of one week from today.
5. In such circumstances, the following Order is passed :
ORDER
(i) The substantive sentence of imprisonment is hereby suspended on the condition that the Appellant shall pay the fine of Rs.1,00,000/- within a period of one week from today.
(ii) The Appellant shall be released on bail on furnishing a PR bond in the sum of Rs.15,000/- with one surety in the like amount, to the satisfaction of the learned Children's Court.
(iii)In the event of breach of any of the conditions, the Order is liable to be recalled.
(iv) Application stands disposed of.
