Heard Mr. Shashikant Joshi, learned Counsel appearing for the petitioner, Mr. P. Dangui, learned Additional Govt. Advocate appearing for the respondents No.1 to 3 and Mr. Suhas Naik, learned Counsel appearing for the respondent No.4.
2. After hearing the matter for sometime, Mr. S.N. Joshi, learned Counsel appearing for the petitioner, seeks leave to withdraw the above writ petition, with liberty to file a fresh petition if at all an occasion arises in future. Mr. S. Naik, learned Counsel appearing for the respondent No.4 submits that the action proposed by the respondent No.4 is to implement the terms of the Memorandum
WP/399/2016 dated 21st November, 2014.
3. We are not examining, in this petition, the legality or otherwise of such Memorandum, and the contentions with that regard raised by the respondent No.4 are to be left open, to be examined in appropriate proceedings.
4. The petition stands, accordingly dismissed as withdrawn, with liberty as prayed for. All contentions of both the parties, including the contention of the respondent No.4 about the maintainability of the petition, are left open. NUTAN D. SARDESSAI, J.
