This is an Appeal challenging the order passed by the learned Company Judge admitting the Company Petition taken out by the Respondent for winding up of the Petitioner-Company. The learned Counsel for the Respondent has placed on record an order passed in Company Application No.7/2018 by the learned Company Judge, dated 5 July 2018.

The learned Counsel for the Respondent has pointed out

2 coa3-17-23-08-18 that the learned Company Judge has permitted withdrawal of the Company Petition and, therefore, the Company Petition is no longer in existence. The learned Senior Advocate for the Appellant submits that in view of the order dated 5 July 2018, nothing survives in this Appeal.

The Appeal is, accordingly, disposed of.

In view of the disposal of the Appeal, the pending Application also stands disposed of.
