1. A decision for cancellation of the allotment of the plot which was allotted to the Petitioner dated 28/1/2019, was taken by Respondent No.2. This decision is assailed in this Writ Petition.

2. Learned Counsel Shri H.D. Naik for Respondent No.2, on instructions and in all fairness, submits that Respondent No.2 will duly hear the Petitioner and then pass a fresh order. The impugned order is, accordingly, set aside. The consequential order dated 15th September 2023 at page 52, is also set aside.

3. The Petitioner to remain present before Respondent No.2 on 18th June, 2024

WP 766 of 2023 2nd July 2024 at 11 a.m. Respondent No.2 may fix the schedule of hearing and inform the Petitioner the date and time of the hearing. It is open for the Petitioner to file his written submissions. After hearing the Petitioner, Respondent No.2 may decide the issue in accordance with law. The Authority to hear the matter without being influenced by the earlier order cancelling the allotment. All contentions are kept open.
