Heard Mr. Khandeparkar, learned Counsel appearing for the Applicant and Shri Mahesh Amonkar, learned Central Government Standing Counsel appearing for the Respondents.

2. This is an application under Section 11(6) of the Arbitration and Conciliation Act, 1996, for appointment of an Arbitrator in terms of the supply order dated 30.12.2013 placed by the Respondents with the Applicant.

3. Upon hearing the learned counsel, it is not disputed that the Arbitration clause as well as the objection raised by the Respondents are common and similar to the one taken in the Application for Appointment of Arbitrator No. 7 of 2015 which has been disposed of

AAR/19/2015 by this Court today.

4. For the reasons stated in the said order, I pass the following :

O R D E R

(i) Shri M. S. Keni, Retired Judge of the City Civil Court at Mumbai, having office at Margao, is appointed as the sole Arbitrator to decide the dispute between the parties. (ii) All the contentions of the parties are left open. (iii) Application stands disposed of accordingly. F. M. REIS, J.
