The amount under cheque was deposited by the respondent no.1 as per order passed by this Court on 3.8.2015.

2. Parties have amicably settled the dispute and produced on record consent terms which is already taken on record.

3. By order dated 3.8.2015, the respondent no.1 was allowed to withdraw the amount, therefore, conviction recorded against the respondent no.1 is hereby set aside. He is acquitted for the offence punishable under Section 138 of the Negotiable Instruments Act. His bail bonds stands cancelled.

4. Petition stands disposed of.
