The learned counsel for the petitioner state that during the pendency of the writ petition, where he has assailed the judgment delivered by the District Judge-2 South Goa at Margao dated 30.10.2018 in a civil revision application, the construction licence has been granted in favour of the respondents and it is also stated that the petitioner intend to assail the act of award of licence in favour of the respondents. In the wake of this, no cause of action survive in the present petition and therefore the counsel for the petitioner seek to withdraw the petition with liberty to raise a challenge qua the fresh cause of action which has accrued on the licence being conferred.

The writ petition is allowed to be withdrawn by reserving the liberty as sought for.
