Heard the learned counsel for the petitioner and the learned counsel appearing for the respondent no.1.
2. The learned counsel for the petitioner submits that the only office objection which survives in the appeal is about not filing of a certified copy of the arbitration award. It is submitted that since after the matter was decided by the learned Principal District Judge, the petitioner has cleared all the dues of the first respondent and the first respondent has issued a No Due Certificate on 25/9/2018 as the account is closed. The No Due Certificate is taken on record and marked "X" for identification.
3. The learned counsel for the respondent does not dispute that
STM/1246/2017 the loan account of M/s. Shreeji Earthmovers has been closed and the entire dues have been paid. In such circumstances, the learned counsel for the parties submit that this Court may pass appropriate orders.
4. The office objection of non filing of the certified copy of the award is hereby dispensed with. The appeal is disposed off as infructuous in view of the fact that the loan account has been cleared and as the first respondent has issued a No Due Certificate. In such circumstances, there shall be no order as to costs.
