This is an application for bail. The applicant has been arrested by the Crime Branch in connection with investigation of Crime No.38/2018 under Section 370-A of Indian Penal Code (IPC) and Sections 4 and 5 of Immoral Traffic (Prevention) Act, 1956. The applicant is working as cook/ house keeper at Sai Guest House at Caranzalem.
2. According to the prosecution, the mobile number of the applicant was circulated for the prospective customers for soliciting girls for sexual exploitation. This is mainly the role attributed to the applicant. There was a trap laid, in which a
CRMAB/109/2018 decoy customer was sent and it is then stated that the applicant brought two girls, who were accordingly, rescued and are sent to Observation Home. Prima facie, it appears that the offence is punishable with imprisonment upto five years. Presently, the applicant is in judicial custody. The application is opposed mainly on the ground that the applicant hails from Karnataka and, therefore, there is likelihood of applicant absconding and not being available for investigation or trial.
3. The learned Counsel for the applicant submits that the applicant now is permanent resident of Goa, where he along with his wife are serving and their children are schooling in Goa.
4. On hearing the learned Counsel for the applicant and the learned Public Prosecutor for the respondents, I find that the apprehension expressed on behalf of the respondents can be taken care of by imposing appropriate conditions. Hence, the following order is passed :
ORDER
(i) The application is allowed.
(ii) The applicant shall be released on bail on executing a PR Bond in the sum of Rs.25,000/- with one solvent surety in the like amount.
(iii)The applicant shall furnish his permanent address in Goa as well as at his native place in Karnataka along with
CRMAB/109/2018 proof to the Investigating Officer.
(iv) The applicant shall attend the Investigating Officer once in every week on Monday between 10.00 a.m. and 1.00 p.m. and as and when required by the Investigating Officer.
(v) The applicant shall not influence or tamper with the prosecution evidence or the witnesses in any manner. (vi) In the event of breach of any of the conditions, liberty to the prosecution to apply for cancellation of bail. (vii)Bail to be furnished before the learned Sessions Judge. C. V. BHADANG, J.
