None present for the applicant.
I have heard Mr. Ramani, learned Advocate for the respondent. I have gone through earlier orders passed by this Court. On 25th February, 2014 this Court has passed order giving clear understanding to the applicant that if the amount is not deposited in this Court, stay granted to the applicant will be vacated. After four weeks, the respondent is free to file execution proceedings. Inspite of orders passed by this Court from time to time, the appellant has not deposited the amount under award. Hence, question of granting stay
CA/66/2015 to the applicant does not arise at all.
Hence, application stands dismissed and disposed of accordingly. After passing of this order, Mr. Hanumant D. Naik, learned counsel for applicant, appeared in the matter and submits that he will file another application for stay to the execution of the award. The applicant/appellant is at liberty to file such application, which will be decided on its own merits.
