IN THE HIGH COURT OF BOMBAY AT GOA

WRIT PETITION NO. 602 OF 2018 Francis Pereira

...Petitioners

Versus

1. The Administrator of Communidades & Ors. ...Respondents Mr Vivek Angelo Rodrigues and Mr. V. Naik, Advocates for the Petitioner.

Mr. Amogh Prabhudessai, Addl. Government Advocate for the Respondent nos.1 and 2.

Coram :

N.M. Jamdar & Prithviraj K. Chavan, JJ Date:

12 June 2018 P.C.

1.

The Petitioner has made a grievance regarding allotment of a plot pertaining to a Communidade of which he is stated to be a constituent.

2.

Learned Counsel for the petitioner states that on 25 August 2016 and 29 June 2017, the petitioner has made representations to the Administrator of Communidade which have not been resolved by the Administrator. He states that in view thereof, since there is no decision, the Petitioner cannot proceed further to invoke the remedy of appeal to the Tribunal.

3.

At this stage, we are not inclined to go into the merits of the contentions raised by the petitioner but the fact that the representations have been remained unanswered have been

Andreza wp602-18dt12-06-18 confirmed by the learned Addl. Government Advocate on instructions. If some representation is made to the Administrator and it is pending for almost two years, they need to be disposed of. The Administrator will accordingly dispose of the representations by taking decision thereupon as per law. The Administrator will keep in mind that the representations are pending for a period of two years and therefore make an endeavour to dispose them of expeditiously.

4.

The Writ Petition is accordingly disposed of by keeping all the contentions of the parties.
