Since the impugned decree orders demolition and a case is made out for admission of the Appeal, it is only appropriate that the execution of the impugned decree dated 23/09/2016 in Regular Civil Suit No. 220/1986/D is stayed.

Accordingly, stay is granted in terms of prayer clause (a) of Civil Application No. 107/2019, which reads as follows: "(a) that pending the hearing and final disposal of the Second Appeal, execution of the Decree dated the 23rd day of September, 2016 of the Civil Judge, Junior Division at Panaji in Regular Civil Suit No.220/1986/D be stayed".
