After hearing the matter for some time, Mr. Agni, learned counsel appearing for the petitioners, upon instructions, seeks leave to withdraw the above writ petition with liberty to avail an alternate remedy by challenging the action of the respondents under the Securitization And Reconstruction Of Financial Assets and Enforcement Of Security Interest Act, 2002 ("The Act" for short hereinafter) before the appropriate Appellate Forum. The writ petition as such stands dismissed as withdrawn with liberty as prayed for. Shri Agni, learned counsel appearing for the petitioners prays for an interim protection to enable him to approach the appropriate forum.
Shri Ajay Kumar, learned counsel appearing for the respondent no.4, upon instructions, states that he will not move the District Magistrate to implement of the order issued under Section 14 of the
WP/483/2016 said Act for a period of five weeks from today. All the contentions of the parties are kept open.
