Heard Shri Valmiki Menezes, learned Counsel appearing for the applicant and Shri A. D. Bhobe, learned Counsel appearing for the respondent.

2. Upon hearing the learned Counsel appearing for the respective parties, I find that the fact that there is a dispute which is covered by the arbitration clause contained in the agreement executed between the parties has not been disputed. In such circumstances, though the names of different arbitrators were exchanged between the parties and the parties did not come to terms with regard to the name of a particular arbitrator, I find it appropriate to appoint Justice U.V. Bakre, retired Judge of this Court, as the Sole Arbitrator to adjudicate the disputes between the parties. Liberty to the parties to apply in case of any difficulty.
