Heard J. Mulgaonkar for the petitioner, Mr. V. Naik for Respondent No.1 and Mr. D. Pangam, learned Advocate General who appears along with Mr. D. Shirodkar, Additional Government Advocate for the State.

Mr. Naik, the learned counsel for the respondent no.1 submits that this petition may not be entertained because the remedy available to the petitioner is in filing of a Civil Suit.

Mr. Mulgaonkar, the learned counsel for the petitioner based on instructions from the petitioner, seeks to withdraw this petition and take out appropriate proceedings before the appropriate forum for redressal of the petitioner's grievances. Accordingly, we grant leave to withdraw this petition with liberty as prayed for. 4.
