Heard Mr. Noorani for the Petitioner, Mr. Shetye for Respondent Nos. 1, 3, 4 and 5, Mr. Vernekar for Respondent No. 2 and Mr. Bhobe for Respondent No. 9.

2. The Petition was filed complaining about illegal land filling in two survey holdings.

3. Mr. Shetye now submits that the Deputy Collector has already issued a show cause notice to Respondent No. 9 under Section 33 of the Land Revenue Code, 1968. He submits that the office of the Survey Town Planner has already intimated to the Police Inspector of 23rd September, 2024

PILWP 21 of 2024 the Calangute Police Station to take suitable action with regard to illegal land filling. Mr. Shetye submits that the inquiry under Section 33 of the Land Revenue Code will be completed as early as possible. He submits that similarly, the issue regarding land filling in the matter under Section 17-A of the TCP Act will be taken up to its logical end by the concerned Police Officer.

4. Since the action has been already initiated by the concerned Authority, we propose to dispose of the present Petition, however, with directions to the concerned Authority to dispose of the proceedings filed under Section 33 of the Land Revenue Code, preferably within three months from today. Similarly, the Police Inspector of the Calangute Police Station shall consider the letter received from the Planning Assistant, office of the Senior Town Planner, in order to take suitable action with regard to the land under Section 17-A of the TCP Act, in accordance with law.
