Heard Shri Costa Frias, the learned counsel for the applicant and Shri Padiyar, the learned counsel for the respondent.

2. The learned counsel for the applicant submits that the applicant shall deposit 50% of the decreetal amount along with interest within a period of eight weeks from today before this court and shall furnish a Bank Guarantee for the remaining 50% along with interest of a nationalized bank.

3. In such circumstances, the application is allowed in the following terms:

(i) There shall be interim stay of the impugned decree subject to

CA/240/2017 the applicant depositing 50% of the decreetal amount along with interest before this Court within a period of eight days from today and with a further condition that the applicant shall furnish a bank guarantee of nationalized bank in respect of the remaining decreetal amount along with interest to the satisfaction of the Registrar (Judicial) of this Court within a period of eight weeks from today.
