1. Heard Mr S. Redkar and Mr Krishna Desai, learned Advocates for the Petitioner.

2. This petition challenges orders dated 19.05.2018 and 04.08.2020, by which an injunction has been granted against the Petitioner pending disposal of Regular Civil Suit No. 90/2018/E.

3. The suit, which is of the year 2018, must have, by now, reached at an advanced stage. To vary an injunction which has been operating for this long does not appear to be appropriate. Besides, this is a matter where two Courts have concurrently deemed it appropriate to grant an injunction. The orders granting injunction are interlocutory until and unless a case of perversity is made out, it would not be appropriate for 17th July, 2025

WP 13 of 2023 this Court to interfere. Accordingly, this petition is disposed of.

4. However, it is clarified that the observations in the impugned orders or the fact that the impugned orders are not interfered with by this Court should not influence the Trial Court in deciding the suit on merits. The suit should be decided on the evidence that the parties lead, uninfluenced by the impugned orders or this order.

5. All contentions of all parties on merits are expressly left open.

6. The petition is disposed of with all the above submissions without any order for costs.
