Learned Addl. Government Advocate appearing for the Respondent no 2, states that as the Petitioner is the only candidate eligible for the concerned post, the DPC will examine her application afresh within one month in accordance with law in view of a certificate produced by the Petitioner that she does not belong to the Creamy Layer of OBC.

Government Advocate appearing for the Respondent no.2, upon instructions of Respondent no. 2, who is present in Court, which is accepted, Shri Lotlikar, learned Senior Advocate appearing for the Petitioner, seeks leave to withdraw the above Petition.
