The learned Counsel appearing for the respondent states that in case the petitioner files an application for regularisation of the disputed structure, the respondent shall examine such application in accordance with law.

2. In view of the above statement, Shri H.D. Naik, upon instruction, seeks leave to withdraw the petition with liberty to challenge the impugned order in case any adverse order is passed against the petitioner on such application.
