Heard Mr. R. P. Desai, learned Advocate for the applicant.

2. The applicant was convicted by the learned JMFC, "B" Court Vasco, for the offence punishable under Section 138 of the Negotiable Instruments Act and was sentenced to undergo simple imprisonment for one year and to pay compensation of Rs.7,00,000/- and in default to further undergo simple imprisonment for another one year.

2. Against that order the applicant has preferred an appeal which was decided by the District Judge, I, South Goa Margao on 15.4.2015 and the appeal is dismissed.

3. Against that order the applicant has preferred this appeal.

4. Mr. R. Desai, learned Advocate has stated that the accused was on bail during the pendency of the criminal case as well as the appeal, therefore, till the disposal of the appeal presented by the applicant, he

CRMA/128/2015 may be released on bail.

5. Hence, accused/applicant be released on bail on furnishing personal bond of Rs.25,000/- with one surety in the like amount to the satisfaction of the Registrar (Judicial) of this Court.

6. Substantive sentence imposed upon the applicant is suspended on a condition that the applicant shall deposit 25% of the compensation in this Court within 30 days in addition to the amount already deposited by the applicant.

7. Application stands disposed of.
