By the present Writ Petition, the order passed by the District Judge-II, South Goa in Misc. Civil Appeal No.102/2012 is assailed. It arise from the impugned order dated 19/10/2012 passed by the Civil Judge, Junior Division where the application for temporary injunction has been granted restraining the defendant No.2 from interfering in the suit property.

The Writ Petition came to be admitted without any interim relief. However, on a Civil Application filed vide No. 228/2013 when the respondent attempted to dispose of the suit property in spite of the order of temporary injunction which was

- 2 - 267-WP-417-2013.odt impugned before the Court, an order of status quo was granted restraining the respondents from creating third party rights until further orders. The said order passed on 13/06/2014 continued till date.

The learned Counsel Mr. Nigel Da Costa Frias submits that the suit is at the stage of evidence. In such circumstances, continuing the order of status quo granted on 13/06/2014 till the final disposal, the Writ Petition is disposed of on the statement that the suit is in progress before the Courts below.
