Sumitra Meghraj Kerkar., v. Meghraj Kerkar.,
1 901 WPCR 93 of 2018.odt
IN THE HIGH COURT OF BOMBAY AT GOA
CRIMINAL WRIT PETITION NO.93/2018 WITH CRIMINAL WRIT PETITION NO.101/2018 WITH CRIMINAL WRIT PETITION NO.94/2018 SUMITRA MEGHRAJ KERKAR ... Appellant.
Versus
MEGHRAJ KERKAR ... Respondent.
Mr. Nikhil Deelip Pai, Advocate for the Appellant. Mr. Parikshit Sawant, Advocate for the Respondent. Coram : M.S. SONAK, J.
Date : 18th February, 2021 ORAL ORDER:
Heard learned Counsel for the parties.
2.
The learned Counsel for the parties hand in consent terms filed Criminal Writ Petition No. 93 of 2018 which are taken on record and marked as "X" for purpose of identification.
3.
The learned Counsel for the parties submit that these consent terms may be taken as filed in companion Criminal Writ Petition
2 901 WPCR 93 of 2018.odt No.94/2018 and 101/2018 which are also today on the board. They submit that all these three petitions can be disposed of based on the consent terms.
4.
The consent terms have been signed by the Advocates as well as the respective parties. The Advocates have identified the respective parties. 5.
The respective parties i.e. Meghraj and Sumitra are present before the Court and they state that they have read and understood the scope and import of these consent terms and they have willingly signed the same. The two major daughters Sumeksha and Sumegha are also present in the Court today.
6.
On perusing the consent terms, I see no good reason why the same should not be accepted. Provisions have been made for the two daughters and Mr. Meghraj Kerkar who is present in the Court states that he will do his best to see that the interests of the daughters are taken care of. 7.
The undertakings recorded in the consent terms are accepted as undertakings given to this Court. The parties will accordingly have to abide by such undertakings and do whatever they have undertaken in the consent terms.
8.
Although there is no reason to believe that the parents will not comply with the consent terms, according to me, over and above what is provided in the consent terms, the parents must endeavour to give their best to their two daughters. Ultimately, in such matters, it is the children
3 901 WPCR 93 of 2018.odt who suffer the most, and therefore, the parents have to ensure that steps are taken to at least reduce such suffering. The consent terms are accepted in the fond hope that the two parents will now act like responsible parents and do everything within their means to ensure the welfare of the daughters. The parents must try to make every attempt to see that bygones are bygones and in any case, the differences or disputes between them do not affect the future of their daughters. 9.
The consent terms are taken on record and all these three petitions are disposed of in terms of what is set out in these consent terms.
10. All concerned to act based on an authenticated copy of this order. M.S. SONAK, J.
