In view of the Consent Terms filed in Second Appeal no. 125 of 2012, Mr. Guru Shirodkar, learned Counsel appearing for the Appellants, upon instructions, seeks leave to withdraw the above Appeal.

2. The Appeal stands accordingly dismissed as withdrawn.

3. It is not disputed by the learned Counsel appearing for the Respondents that the amounts deposited by the Appellants has to be withdrawn by the Appellants in view of the Consent Terms.
