This is an application for suspension of sentence imposed on Mapusa Correction carried out as per order dated 22/04/2025 sd/- the Applicant already convicted by the J.M.F.C. at Panaji in Criminal Case No.OA/272/NIA/2017/C. The Magistrate has imposed a sentence of simple imprisonment for a period of three months and directed the Applicant to pay a fine of Rs.2,40,589/- and in default of payment of the fine/compensation, to undergo further simple imprisonment of three months.

The order of the Magistrate was challenged in Criminal Appeal No.87/2024 before the Sessions Court at Panaji which was ultimately dismissed on 11.04.2025, and the Applicant was taken into custody and is presently lodged at Colvale Central Jail. It appears that during the course of the Appeal, the Applicant had deposited an amount of Rs.1,50,000/-, and an amount of Rs.90,589/- is outstanding as payment of compensation to the Respondent.

The Applicant is now willing to deposit an amount of Rs.90,589/- which shall be deposited with the Registry of this Court within one week from today. Considering that the Applicant has deposited a total amount of Rs.1,50,000/-, the sentence imposed on the Applicant shall stand suspended till further orders, on the Applicant furnishing a PR Bond of Rs.10,000/- before the Superintendent, Central Jail, Colvale. On execution of the PR Bond and on his release, Applicant shall execute PR Bond of Rs.10,000/- Mapusa Correction carried out as per order dated 22/04/2025 sd/- with one surety in the like amount before the J.M.F.C., Panaji within one week to secure the suspension of his sentence. 5.

The Superintendent, Colvale Jail, shall forward the PR Bond executed before it to the concerned Magistrate. 6.

Application stands disposed of.
