We have heard Mr. Joaquim Godinho, the learned Counsel appearing for the Petitioner and Shri P. Faldessai, learned Additional Government Advocate appearing for the Respondents no. 1 to 3.

2. The main grievance of the Petitioner is that amongst the nomination filed for holding the elections of the concerned Society, five were disqualified and, as such, according to the Petitioner, taking advantage of such situation the Respondents are not justified to delay holding the elections of the concerned Society.

3. Mr. P. Faldessai, upon instructions of Ms. Smita Kankonkar, Cooperative Officer/Special Auditor, states that the process of holding elections of the concerned Society shall be completed within

WP/469/2016 four months under Section 52 of the Co-operative Societies Act, at the cost of the concerned Society. Shri J. Godinho, the learned Counsel appearing for the Petitioner, states that the above petition may accordingly be allowed to be withdrawn, accepting the said statement of the Officer.

4. Hence, accepting the statement of the concerned officer, leave granted. The petition stands dismissed as withdrawn accordingly. NUTAN D. SARDESSAI, J.
