Shri Nigel Da Costa Frias, learned Counsel for the respondent Nos.1 to 10 has no objection to the encashment of the Bank Guarantee furnished by the applicants before the Industrial Tribunal. However, the proceeds be deposited in the account of the Industrial Tribunal and leave be granted to the respondent Nos.1 to 10 to apply to the Tribunal for the disbursement of the said amount towards the legitimate dues of the workers.

2. Leave granted to the said respondents to apply to the Industrial Tribunal which shall decide the application on its own merits and upon hearing the parties.

3. In view thereof, the application is allowed for encashment of the Bank Guarantee by the Industrial Tribunal.

4. The application accordingly stands disposed off.
