Ms A. Fernandes, learned counsel for the Petitioners based on express written instructions from the Petitioners seeks leave to withdraw this petition unconditionally. Further, she places on record the written application signed by the Chairperson and Secretary of the Petitioners' society seeking leave to withdraw this petition.

2. Since the request is for unconditional withdrawal of the petition, the same is granted. However, this does not mean that this Court has either accepted or rejected whatever is stated in para 1 of the application. Mr Agni, learned counsel for the Respondent also states that since the plea is for unconditional withdrawal of this petition, the same cannot be opposed. However, he clarifies that nothing contained 8th September, 2023

WP 399 of 2022 in the application seeking leave to withdraw the petition should be held as accepted or admitted by the Respondent.

3. Accordingly, leave is granted and this petition is disposed of as withdrawn.
