Heard Mr. A. Prasad, learned counsel appearing for the applicant and Mr. M. Salkar, learned counsel appearing for the respondent.

2. The above application filed by the applicant on the premise that the amount as directed by this Court to be deposited while examining the petition filed for winding up by order dated 11.09.2015 has not been complied with. The respondent filed affidavit inter-alia pointing out that the amount in terms of the said order has already been deposited within the time specified. When the records were verified, in fact such amount has been deposited. As the assumption on which the application has been filed by the applicant

COAP/32/2016 does not survive, the question of entertaining the above application does not arise at all. Needless to say, the consequence as pointed out in the operative portion of the order passed by this Court dated 11.09.2015 in view of such deposit the consequences would automatically operate accordingly.
